These Terms and Conditions govern the relationship between RDPhotos ("the Photographer") and the Client ("you"). By booking a session or purchasing services through RDPhotos.co.uk, you agree to be bound by the following terms.
1.1. A booking is considered "confirmed" only once the Photographer has received a signed agreement (where applicable) and a non-refundable retainer fee of 20% of the total amount has been paid forward.
1.2. The retainer secures the date and time of the session, covers admin fees and is deducted from the total project cost, it is not an additional payment on top.
1.3. The remaining balance must be cleared up to 30 days after the shoot (photos will not become available until it is)
2.1. Validity: All special offers, seasonal "mini-session" deals, and discount codes are subject to availability and must be booked within the specified time-frame.
2.2. Exclusions: Promotional deals cannot be used in conjunction with any other offers, vouchers, or prior bookings unless explicitly stated in writing.
2.3. Modification: Rd-photos reserves the right to amend or withdraw promotional offers at any time without prior notice. However, all confirmed bookings made under a specific deal will be honored at the agreed price.
2.4. Vouchers: Gift vouchers or credit notes are non-refundable and must be redeemed within [12 months] of the date of issue.
3.1. Client Rescheduling: If you need to move your session, please provide at least [48 hours] notice. We will attempt to move your booking to a new date; however, this is subject to the Photographer’s availability.
3.2. Client Cancellation: If a booking is cancelled by the Client, the retainer fee is forfeited.
3.3. Photographer Cancellation: In the highly unlikely event of a cancellation by RDPhotos due to emergency or illness, you will be offered a full refund of all monies paid or a priority reschedule.
4.1. Copyright: Under the Copyright, Designs and Patents Act 1988, the copyright of all images remains with RDPhotos.
4.2. Personal License: The Client is granted a non-exclusive license to use the images for personal purposes (e.g., social media, personal prints, and sharing with friends/family).
4.3. Prohibited Uses: The Client may not edit, filter, or alter the images, nor sell them to third parties or use them for commercial/business purposes without a separate written license.
4.4. Portfolio Use: RDPhotos reserves the right to use the images for self-promotion, including website portfolios, social media, and printed marketing materials, unless the Client requests otherwise in writing prior to the shoot.
5.1. Editing Style: The Photographer will perform standard post-processing. The Client acknowledges they have chosen the Photographer based on their specific artistic style and that requests for "raw" or unedited files will not be entertained unless paid for.
5.2. Timeline: Digital galleries are typically delivered within 14 days. During peak seasons, this may be extended, and the Client will be notified accordingly.
5.3. Archiving: RDPhotos will keep your images on file for [6 months] from the date of delivery. After this period, we cannot guarantee the recovery of lost files.
6.1. RDPhotos maintains professional indemnity and public liability insurance.
6.2. In the event of total photographic failure or loss of digital data, the Photographer’s liability shall be limited to a full refund of all money paid to the Client.
6.3. The Photographer is not responsible for any impact on image quality caused by uncooperative subjects or adverse weather conditions beyond our control.
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
